Seek First — Terms of Service (Australia)

These Terms of Service ("Terms") govern your access to and use of the Seek First online store and any related services (together, the "Services"). By visiting our site, placing an order, or otherwise using the Services, you agree to be bound by these Terms.


1. Who we are

Seek First operates an ecommerce store hosted by Shopify Inc. (or its affiliates). Additional third‑party services may be used for payments, shipping, analytics, and communications.


2. Eligibility & accounts

  • You must be at least 18 years old (or have parental/guardian consent) to purchase.

  • You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account. Notify us immediately of any unauthorised use.


3. Products, availability and colours

  • We try to describe products accurately; minor variations (e.g., colour, texture, placement of embroidery/prints) may occur due to screen settings, batch differences, or handmade processes.

  • We may limit quantities, discontinue products, or refuse/cancel orders at our discretion (e.g., suspected fraud or pricing errors). If we cancel, we’ll refund any amount paid for the cancelled items.


4. Pricing, currency and taxes

  • Prices are shown in AUD. For Australian orders, prices are GST‑inclusive unless stated otherwise. For international orders, local taxes/duties may be charged by your customs authority—these are your responsibility.

  • We may change prices at any time before you place your order.


5. Orders & contract formation

  • Your order is an offer to buy. A contract is formed when we email you an order confirmation or dispatch notice.

  • Please check your details carefully; once an order is placed we may not be able to modify it.

  • Pre‑orders and made‑to‑order items: estimated dispatch windows are indicative only and may change. We’ll keep you informed of material changes.


6. Payment

  • We accept the payment methods shown at checkout (e.g., credit/debit cards, Shop Pay, Apple/Google Pay, Afterpay).

  • By submitting a payment method you represent you are authorised to use it and authorise us (or our payment processors) to charge the order total, including shipping, taxes, and any agreed adjustments.


7. Shipping & delivery

  • Shipping options, fees and estimated timeframes are shown at checkout and in our Shipping Policy. Estimates are not guarantees; carrier delays are outside our control.

  • Risk of loss passes on delivery to the shipping address provided. If a parcel is returned due to incorrect/insufficient address or non‑collection, we may recharge re‑delivery fees.

  • Title passes when we receive full payment.


8. Returns, exchanges and refunds

Please review our Returns Policy for process and timeframes.

Your rights under the Australian Consumer Law (ACL): Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Change‑of‑mind returns (store policy):

  • 30 days from delivery for unused items in original condition/packaging; final sale items excluded; custom/embroidered items not eligible unless faulty.

  • To start a return, contact us at ruardat@gmail.com with your order number. Return shipping costs are not refundable unless we made an error or the product is faulty.

This section applies in addition to, and does not limit, any rights you have under the ACL.


9. Faulty items

If a product is faulty or not as described, contact us promptly with proof of purchase and photos. We’ll assess and offer a repair, replacement, refund or other remedy consistent with the ACL. Do not continue using a product that appears unsafe.


10. Promotions, gift cards & credits

  • Promotions and discount codes cannot be combined unless explicitly allowed; single‑use codes are void if shared publicly.

  • Gift cards are non‑refundable and redeemable only for eligible products/services on our store; they cannot be exchanged for cash except as required by law.

  • Gift cards do not have an expiry date.


11. Subscriptions & pre‑orders (if offered)

  • Subscriptions auto‑renew at the stated interval until cancelled. You may cancel at any time effective at the end of the current billing period.

  • We may adjust subscription pricing with prior notice; you can cancel before changes take effect.

  • Pre‑order dates are estimates and may change; your statutory rights remain unaffected.


12. User content (reviews, photos, social tags)

If you post a review on our site or tag us on social media with our brand hashtags (e.g., #seekfirstapparel), you grant us a royalty‑free, worldwide licence to use, reproduce and display that content for marketing, in accordance with our Privacy Policy. You must own the content and it must not infringe others’ rights or contain unlawful or offensive material.


13. Acceptable use

You must not misuse the Services, including by:

  • interfering with security or functionality;

  • scraping, data‑mining or reverse‑engineering except as permitted by law;

  • using the Services for unlawful, harmful, or fraudulent purposes.


14. Intellectual property

All text, graphics, logos, product designs (including embroidery/prints), photos, videos, and software on the Services are owned by us or our licensors and protected by IP laws. You may not use our trademarks or designs without prior written consent.


15. Communications & marketing consent

  • Email/SMS marketing: We send commercial electronic messages only with consent and provide an easy way to unsubscribe (e.g., link in emails; reply STOP to SMS). Our Privacy Policy explains how we collect, use and store your personal information and your choices.

  • Transactional messages: We may send non‑marketing messages about your orders, account or service updates.

16. Third‑party services

Our store is hosted by Shopify. Your use of payment gateways, shipping apps, or other third‑party tools may be subject to their own terms and privacy policies. We are not responsible for third‑party services and do not warrant their performance.


17. Warranties, disclaimers & liability

  • We provide the Services using reasonable skill and care but do not guarantee uninterrupted, timely, secure or error‑free operation.

  • Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the ACL or any other law that cannot be excluded.

  • To the extent permitted by law, and other than for liability that cannot be excluded under the ACL, our liability for any claim relating to the Services or goods is limited, at our option, to: (i) in the case of goods—replacement of the goods or supply of equivalent goods, repair of the goods, payment of the cost of replacing or acquiring equivalent goods, or payment of the cost of having the goods repaired; and (ii) in the case of services—supply of the services again or payment of the cost of having the services supplied again.

  • We are not liable for loss of profit, revenue, goodwill or any indirect or consequential loss, except as required by law.


18. Indemnity

You indemnify us against losses, costs and expenses arising from your breach of these Terms or misuse of the Services, except to the extent caused by our own negligence or breach of law.


19. Privacy

Your submission of personal information through the store is governed by our Privacy Policy. Please review it to understand our practices, including for direct marketing and your rights under privacy law.


20. Force majeure

We are not responsible for delay or failure to perform due to events beyond our reasonable control (e.g., natural disasters, pandemics, strikes, carrier delays, internet outages, or government action).


21. Changes to the Services or these Terms

We may update these Terms from time to time. The latest version will be posted on this page with the effective date. If changes are material, we’ll provide reasonable notice. Your continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of South Australia and the **Commonwealth of Australia
